Terms of Service
These terms govern this website and any FormHeartbeat managed pilot agreed in writing. The pilot is a limited monitoring service—not a guarantee that a website will never lose a lead.
1. Operator and contact
FormHeartbeat is currently an independent product operated by its founder, Wei. Contact: founder@formheartbeat.com. FormHeartbeat is not represented as an incorporated company.
2. The managed pilot
Unless a written order says otherwise, the $49 pilot lasts 30 days and covers up to five websites and ten compatible public forms, daily scheduled checks, email failure alerts, manual setup and one summary report.
The pilot currently supports public, single-step forms without mandatory CAPTCHA challenges. Compatibility, schedule, test data and destination evidence must be agreed before activation.
3. Customer responsibilities
You confirm that you are authorised to request tests on each supplied form and destination. You must provide accurate configuration information, approve recognisable test data, tell relevant client personnel about test submissions, and avoid supplying sensitive or unlawful content.
4. What monitoring does and does not prove
A successful check proves that a specific scheduled test completed the configured browser and delivery steps at that time. It does not guarantee continuous availability, delivery of every real lead, CRM accuracy, security, regulatory compliance or recovery from every failure.
5. Alerts and false results
Websites, networks, inboxes and third-party services can delay or block checks. FormHeartbeat may retry or manually review a result, but alerts can be delayed, missed or incorrect. You remain responsible for your own operational response and client commitments.
6. Payment and refund
Pilot fees are due before activation unless agreed otherwise. If FormHeartbeat cannot successfully configure at least one agreed compatible end-to-end form test within three business days after receiving the required access and information, you may request a full refund. Other refunds are discretionary unless required by law.
7. Suspension
We may pause or refuse checks that appear unauthorised, unsafe, unlawful, abusive, technically harmful, incompatible, or likely to trigger spam, CAPTCHA or third-party restrictions.
8. Confidentiality and evidence
Non-public configuration and pilot information will be used only to provide and improve the agreed service, subject to the Privacy Policy. Do not send credentials by ordinary email unless specifically requested through an agreed secure method.
9. Warranty and liability
The website and pilot are provided on an “as available” basis. To the maximum extent permitted by applicable law, total liability relating to a pilot is limited to the amount paid for that pilot. FormHeartbeat is not liable for indirect loss, lost profit, missed enquiries, reputational damage or failures outside its reasonable control.
10. Ending the pilot
Either party may end the pilot by written notice. Monitoring stops at the end of the agreed period unless renewed in writing. Sections intended to survive—including payment, confidentiality, liability and lawful use—continue to apply.
11. Changes
Terms may be updated as the service evolves. The version accepted for a paid pilot remains applicable to that pilot unless both parties agree otherwise.
